This page outlines the service conditions that apply when you use HostMyCode hosting products, billing systems, and related services.

Acceptance of terms and service scope

These Terms of Service apply to all users of HostMyCode services, including account holders, service subscribers, and anyone using or accessing services delivered through a HostMyCode account.

By ordering, using, renewing, or continuing to use any HostMyCode service, you agree to these Terms of Service together with the Acceptable Use Policy, Refund Policy, Privacy Policy, and any product-specific terms that may apply to the service you purchase.

HostMyCode provides infrastructure and hosting-related services on a commercially reasonable, best-effort basis unless a separate written agreement expressly states otherwise.

Accounts, customer responsibility, and service use

You are responsible for maintaining accurate account information, protecting login credentials, and ensuring that activity under your account complies with applicable law and HostMyCode policy requirements.

You are responsible for your websites, applications, content, software, data, email use, scripts, and any third-party tools or code you deploy on HostMyCode infrastructure.

You must maintain your own current backups and recovery procedures. Unless a backup service is expressly included with your plan, HostMyCode does not act as the sole repository or guaranteed recovery source for your data.

Billing, renewals, and refunds

HostMyCode offers billing cycles based on the service purchased, including monthly, quarterly, semi-annual, annual, or other stated terms. By placing an order, you authorize HostMyCode to invoice you according to the billing term selected at checkout.

Services renew under the billing model and renewal settings in your client account unless cancelled in accordance with applicable policy or product rules. It is your responsibility to review invoice notices, renewal dates, and service status.

Refund eligibility is governed by the applicable Refund Policy and the specific service purchased. Domain registrations, transfers, dedicated servers, selected promotional offers, and certain payment methods may be non-refundable or credit-only.

Service availability, maintenance, and best effort operation

HostMyCode works to maintain stable and reliable service using commercially reasonable efforts, but services are not provided with a service level agreement or uptime credit commitment unless a separate written SLA expressly applies to your account or service.

Maintenance, repairs, upgrades, security actions, upstream network issues, third-party software failures, customer configuration issues, DDoS events, routing anomalies, registrar delays, and other events inside or outside our direct control may affect service availability from time to time.

Service interruptions, degraded performance, or temporary inaccessibility do not create a right to service credits, refunds, or damages unless such remedy is expressly required by a separate written agreement.

Suspension, termination, and late payment

HostMyCode may suspend, restrict, or terminate services for non-payment, policy violations, abuse complaints, fraud risk, security concerns, harmful activity, or any situation that may affect our network, other customers, or legal compliance.

If an invoice remains unpaid after the due date, the service may be suspended and may later be terminated if payment is not received within the applicable grace period for that service. Restoration or reactivation is not guaranteed and may depend on data retention status, available capacity, and payment of outstanding charges.

HostMyCode reserves the right to refuse service, decline reactivation, or require additional verification where account activity creates legal, operational, or payment risk.

Limitation of liability and warranty disclaimer

All services are provided on an 'as is' and 'as available' basis, and HostMyCode disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

HostMyCode is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of business, loss of goodwill, or loss of data, even if advised of the possibility of such damages.

To the fullest extent permitted by law, HostMyCode’s total liability arising out of or related to the services will not exceed the amount paid by you for the affected service during the billing period immediately preceding the event giving rise to the claim.

Indemnification and customer obligations

You agree to defend, indemnify, and hold HostMyCode harmless from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the services, your content, your business activities, or your breach of these Terms or related policies.

This includes claims related to intellectual property infringement, unlawful content, spam, abusive traffic, malware, privacy violations, product claims, customer disputes, or damage caused to third parties in connection with your use of HostMyCode services.

Where required, you must cooperate with reasonable requests for information, complaint handling, incident investigation, and abuse-response procedures related to your account or services.

Affiliate program, policy changes, and final provisions

If you participate in the HostMyCode affiliate program, commission eligibility, qualification rules, payout timing, and disallowed conduct are governed by the affiliate terms in effect at the time of referral review. Self-referrals, abusive referrals, fraudulent activity, or attempts to manipulate referral tracking are prohibited.

HostMyCode may revise these Terms of Service at any time by publishing an updated version on its website. Continued use of the services after changes become effective constitutes acceptance of the revised terms.

If any provision of these terms is found unenforceable, the remaining provisions will remain in effect. By using HostMyCode services, you confirm that you have read, understood, and agreed to these Terms of Service.
